Panhandling on a sidewalk has substantial elements of "expressive
activity"
which involves the "civil liberty" of freedom of expression. People
will perceive
your panhandling differently on whether you are sitting or standing.
If you are
sitting, you will seem safer to approach or pass by. If you are
standing, a passerby
might not feel as safe and might avoid you completely at a "safe
distance".
The "sit-lie" ordinance interferes with this choice of personal
expression. It creates
government-mandated non-verbal expression to others by making the
panhandler stand up.

On the second point above, the bums on the streeets are not the major
entitlement bunnies of our society,
